Terms of Service

By booking services with Caleb Media Studio (the "Service"), you agree to be bound by these Terms of Service. If you don't agree to these terms, please don't book.

"You" or "Client" refers to the person booking the service. "We," "us," or "Caleb Media Studio" refers to the service provider.

Caleb Media Studio provides two primary services:

• Video Highlights: Filming and editing sports highlight reels for personal use, recruiting, and social media
• Action Photography: Professional sports photography including action shots, candid moments, and portrait-style photos
• Combo Packages: Video and photo coverage at the same event, switching between formats throughout the game

Important: For combo packages, I use one camera body and switch between shooting video and photos during the event. This means the exact same moment cannot be captured in both photo and video format, but you'll get comprehensive coverage in both formats throughout the event.

Services are booked on a per-event, per-athlete basis. One booking covers one athlete at one event. Team coverage or multiple athletes require separate bookings.

Payment Structure: Services require a 50/50 payment split:

• 50% due on the day of the event (before filming/photography begins)
• 50% due before final delivery of edited content

Accepted Payment Methods: Cash App, Venmo, Zelle, PayPal, or cash in person.

Travel Fees: Events within 5 miles of Oviedo, FL are included. Additional travel is charged at $5 per 5-mile increment, added to the total price.

Event Entry: You're responsible for providing or covering the cost of any tickets, passes, or fees required for venue entry.

More than 48 hours before the event: Full refund if payment has been made.

Less than 48 hours before the event: 50% of the total booking fee is forfeited. The remaining 50% can be refunded or applied to a future booking.

No-show or same-day cancellation: 100% of the booking fee is forfeited. No refunds will be issued.

If I need to cancel due to illness, emergency, or unforeseen circumstances, you'll receive a full refund or the option to reschedule at no additional cost.

Raw Footage & Photos: All raw, unedited footage and photos remain the property of Caleb Media Studio. You do not receive access to raw files unless explicitly agreed upon in advance.

Edited Content: You receive a license to use the edited highlight videos and processed photos for personal, recruiting, and social media purposes. Ownership of the edited content remains with Caleb Media Studio, but you have full rights to use it as outlined in Section 6.

You're granted a non-exclusive, worldwide license to use the edited content for:

• Personal use and sharing with family and friends
• College recruiting purposes (highlight reels, recruiting profiles, emails to coaches)
• Social media posts on any platform (Instagram, TikTok, YouTube, Twitter, etc.)
• Personal websites or athlete profile pages

You may NOT:

• Resell, redistribute, or license the content to third parties
• Use the content for commercial purposes without written permission
• Remove watermarks, credits, or branding (if present)

Caleb Media Studio reserves the right to use edited content (videos and photos) for portfolio, marketing, and social media promotion unless you request otherwise in writing before delivery.

Caleb Media Studio is not liable for:

• Injuries, accidents, or incidents that occur during the event
• Venue access issues, facility rules, or ejection from the event
• Equipment failure or technical issues beyond our control
• Weather-related cancellations or disruptions (see Section 8)
• Loss of footage or photos due to theft, damage, or data corruption (though we take precautions to prevent this)

Services are provided "as is" without warranties of any kind. While we strive for high-quality results, we don't guarantee specific outcomes, highlight counts, or photo quantities.

Weather Delays or Cancellations: If an event is postponed or canceled due to weather, you can apply your payment to the rescheduled date or request a full refund.

Venue Access Issues: If we're denied entry to the venue due to facility rules or restrictions, you can choose to reschedule or receive a full refund. No refunds are provided if you fail to provide required entry tickets or passes.

Event Postponements: If the event is rescheduled and we're available, your booking automatically transfers to the new date. If we're not available, you can request a full refund.

No Guarantee: You're paying for filming/photography time and editing work, not a guaranteed number of highlights or photos. If the athlete has limited playing time, limited action, or doesn't get on the field/court, no refund will be issued.

I'll capture what's available during the event, but I can't control coaching decisions, substitutions, injuries, or game flow. The final deliverable will reflect what was captured during the event.

Standard Delivery: Edited content is typically delivered within 2-4 days after the event and receipt of final payment.

Rush Delivery: Available for an additional $10 fee. Rush delivery is typically within 24-48 hours, subject to availability and workload.

Delivery times are estimates, not guarantees. Delays may occur due to workload, technical issues, or unforeseen circumstances. You'll be notified if delivery will be delayed beyond the estimated timeframe.

As the client, you're responsible for:

• Providing accurate event details (date, time, location, athlete info)
• Notifying us of any changes to event details as soon as possible
• Ensuring we have access to the venue (tickets, passes, entry fees)
• Responding to messages in a timely manner (within 24 hours when possible)
• Providing payment according to the agreed schedule
• Identifying the athlete at the event if requested (jersey number, physical description, photo)

Failure to provide accurate information or timely responses may result in missed coverage or delays in delivery.

If you're not satisfied with the service, reach out to discuss the issue before leaving negative reviews or initiating chargebacks. Most issues can be resolved through good-faith communication.

Governing Law: These terms are governed by the laws of the State of Florida, USA.

Jurisdiction: Any disputes will be resolved in the courts of Seminole County, Florida.

Information Collection: We collect your name, contact information (phone/email/Instagram handle), event details, and payment information as needed to provide the service.

Data Usage: Your information is used solely for booking, communication, and service delivery. We don't sell or share your information with third parties except as required by law or payment processors.

Content Storage: Edited content may be stored on our devices and cloud storage for backup purposes. Raw footage and photos are typically deleted after final delivery to free up storage space.

Caleb Media Studio reserves the right to update these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date at the top.

By continuing to use the service after changes are posted, you agree to the updated terms. If you don't agree to the changes, please don't book future services.

For bookings made before a terms update, the terms in effect at the time of booking will apply to that specific booking.
